Details Of Ruling That Set Free Al-mustapha

In the lead judgment delivered by Justice Rita Pemu and supported by the presiding judge, Justice Amina Augie andJustice F. O. Akinbami respectively, the court held that the prosecution failed to prove its case beyond reasonable doubt, and that there was no nexus between the appellants and the murder of Alhaja Kudirat Abiola on June 4, 1993.

The Augie led all-female appeal panel had taken over the case from Justice Ibrahim Saulawa, who withdrew on April 29, for personal reasons.

Justice Pemu in setting aside the judgment of the lower court, held that the prosecution failed to establish the charge of conspiracy and murder against the appellants and that it was foolhardy and unreasonable for the lower court to have so swiftly convicted the appellants, when it was very evident that the prosecution had a bad case.

Resolving all the three issues raised against the prosecution, Justice Pemu held that there existed a huge shadow of doubt in the case of the prosecution, which ought to be resolved in favour of the appellants.

She submitted that the testimonies of all the prosecution witnesses were worthless and could not sustain the offence of conspiracy or murder for which the appellants were convicted.

The appellate court lampooned the lower court, saying that the 326-page judgment delivered by the trial judge was needless and an indication that the trial judge was finding a way round the doubts created by the prosecution.

The court said that none of the prosecution witnesses added any value to the case adding that “the 326-page judgment could not provide evidence where none existed," noting that ‘’the prosecution has failed to produce the bullet that was extracted from the skull of the deceased (Kudirat).

If the bullet was made available it would have needed a ballistician to verify what kind of bullet it was. The prosecution failed to say why the bullet was not produced at the trial. This is fatal to their case.’

In a criminal trial the burden of proof is beyond reasonable doubt and this is a chain that cannot be broken.

"The prosecution listed four witnesses PW 9, 10, 11 and 12 as witnesses which it intended to call in the trial, but never called any of them.

"PW 1 (Dr Ore Falomo) testified before the lower court that the bullet extracted from the forehead of the deceased was white and of a special kind, but the prosecution failed to tender the bullet as exhibit and this is fatal to their case.

"The prosecution also called Pw 4 (Investigating Police officer) who investigated the death of the deceased, but this witness was never produced for cross examination by the defence, as he never showed up in court.

"This renders the evidence of the police officer inconclusive as it denied the defendants their right to fair hearing, and no reasonable court can safely make a conviction on such inconclusive testimony.

"PW 2 (Sgt. Rogers) and PW 3( Mohammedd Abdul) in their confessional statement to the police, said they were enjoined by the first appellant, to murder Kudirat, but this statement was later retracted by them in court.

"PW 2 and 3 retracting their earlier statement to the police told the court that they were cajoled by the prosecution to indict the appellant, with a promise to give them monetary compensation.

Justice Pemu held “It is obvious that the prosecution witnesses fielded by the prosecution at the trial have been so discredited even in cross examination that no reasonable court can convict the appellants based on the available evidence placed before the court.’’

The court held that “where evidence of witnesses are contradictory, it is the duty of the judge to discountenance same, and treat the entire evidence as unreliable, it a duty in law and not discretion.

I found nothing in this charge to necessitate their being convicted.

For anyone who has been incarcerated since 1999, a period of about 14 years, this is unfortunate.’’

The court pointed out that the investigation into the murder of Alhaja Kudirat was shoddy, saying “there was no proper police investigation, no reliable exhibits, no circumstantial evidence, nothing.

The result is that all the issues are resolved in favour of the appellants and against the respondent who has failed to prove the charges against the appellants beyond reasonable doubt.

‘’The inference it deduce from the evidence must accord with common sense and good judgment. Its evaluation of same must be fraught with equity and its assessment of them must not be perverse.

A judge should eschew reliance on sentiments which may present itself in a subtle form in the determination of every dispute before it and in the performance of the sacred duty of the due administration of justice.

‘’The appeals succeed and allowed and I hereby make an order that the appellants who were convicted on the offence of conspiracy to murder and murder of Alhaja Kudirat Abiola on the 4th of June 1996 in a judgments of Justice M. A. Dada delivered on January 30, 2012 are hereby discharged and acquitted, while the conviction and sentences are hereby set aside.’’

"For someone who has been incarcerated since 1998 on a baseless indictment, it is so unfortunate," Pemu said. 

7 Killed As Petrol-Tanker, Trailers Crash In Onitsha

Seven persons were crushed to death at the Upper Iweka axis in the commercial city of Onitsha when a petrol tanker, a truck belonging to Dangote Group and another carrying 40 feet container crashed in the city.

Saturday Sun gathered that the first tanker lorry with registration number, XG 613 AKR had failed brake opposite the Toronto hospital along Onitsha-Asaba Expressway, crushing people especially motorists along the ever busy Upper Iweka area.



However as the men of the Federal Road Safety Corps, FRSC were still busy evacuating the bodies, a trailer lorry carrying a 40 feet container with registration number XA353 GGU and another trailer carrying Dangote Cement also had failed brakes and crushed other road users.

The first incident claimed the lives of two men and a woman who were on their way home after the day's job while the second and third incidents claimed the lives of a commercial motorcyclist and his passengers whose bodies were mauled beyond recognition.

Narrating his experience, a survivor of the second accident in a vehicle with registration number DL486ENU who pleaded anonymity said his escape was miraculous since the trailers lost brakes and were busy crushing their victims from the Toronto hospital to the foot of the Upper Iweka fly-over.

"I was coming back from my office, am a lawyer, when I got to Upper Iweka, I saw a terrible traffic gridlock, I was told that a tanker lorry failed brake and crushed people at the area. I also noticed that vehicles were parked along the road, suddenly as I was still at the traffic gridlock, I heard frightening sound, before I could know what was happening, two trailers carrying container and cement had lost brakes and started crushing people"

He further stated "I could not jump out of my car because I was like a person glued until I heard a great bang and I thought I was dead, it was people that came and brought me out, but up till now, I can't really say what happened to me but everybody that saw me come out of the car told me to thank my God"

Another eyewitness who gave his name as Dozie Okonkwo, a bus conductor said that the only woman that died in the incident was a daily money collector who had closed for the day and was on her way back to her home at Old Road, Onitsha.

"She came to enter our bus, I told her that the price was N70, she jumped out because she wanted a cheaper one, not quite long, the incident happened, when we rushed there, she was already crushed, her body was already crushed, it was only her cloth that some people used to recognize her, her flesh was scattered all over the place"

However the first tanker lorry was said to be coming from a filling station where it had dispensed its product in the commercial city of Onitsha and was on its way to Port Harcourt when the driver allegedly lost control of the vehicle, skidded off the road and crushed people.

The Onitsha Unit Commander of the Federal Road Safety Corps, FRSC, Mr. Anthony Meta could not comment on the incident as he refused to pick his calls. An officer who did not want his name in print confirmed the incident and said he personally led his team to deposit the bodies of the victims in the mortuary and took the injured persons to Toronto Hospital for medical attention.

Soyinka Is An Embarrassment To His Admirers – Patience Jonathan

Wife of the President, Mrs. Patience Jonathan, on Friday took on the Nobel Laureate, Prof. Wole Soyinka, for attributing the crisis in the Rivers State House of Assembly to her.

In a statement by her spokesman, Ayo Osinlu, the President’s wife said Soyinka betrayed the moral duty that expected him, as a respected member of the society, to carefully consider all shades of issues that informed his opinions on any matter.

Mrs. Jonathan said Soyinka had become an embarrassment to his admirers with his diatribe against her.

The statement read in part, “Unfortunately, Soyinka betrayed moral duty in his recent diatribe against Mrs. Patience Jonathan.

“Of course, this would not be the first time he would reach out against the First Lady, usually from self-righteously indignant lecterns.

“In this particular instance, his verdict was that Mrs. Jonathan was ‘stoking the crisis currently rocking her home state of Rivers…’, and thereupon asked Mr. President to caution his wife.

“The good, old Prof. reminds one of the truth that indeed, most of the giants on the street are men of like passions like everyone else. Worse still, most of them are actually standing on clay feet and would fail the test of a gentle push.

“Otherwise, who would have believed that the social, civil, constitutional and sundry rights crusader Prof. would maintain a safe distance from the heart of an activity that is a potential threat to the peace, security and safety of the people of a state, then collect exaggerated stories and jaundiced perspectives from familiar propagandists and character assassins, and promptly summon the media to a “state of the nation” address.

“It’s an embarrassment to his throng of admirers and followers, that a sage of Prof. Soyinka’s status, who used to be a gauge of public morality in this nation, would lend himself to a propaganda of high drive, to save a governor who elected to launch into a river without applicable survival skills.”

Mrs. Jonathan argued that the calculation was to attack the President and pull to pieces anyone associated with him, as a strategy for attracting public sympathy to the “clear underdog.”

Port-Harcourt-based Firms Dump Wastes In Aba — Ikpeazu

UMUAHIA— ABIA State government, yesterday, alleged that some Port-Harcourt-based companies owned by expatriates were dumping industrial wastes in Aba.

Deputy General Manager, Abia State Environmental Protection Agency, ASEPA, Dr. Okezie Ikpeazu, who made the allegation, said the unidentified companies connived with lorry drivers to lift the wastes and dump illegally in Aba. He said one suspect, a truck conductor, has been arrested and his truck impounded.
Ikpeazu said the suspect allegedly dumped 90 tonnes of suspected toxic wastes generated in Port Harcourt in the commercial city, adding that the industrial wastes would be sent to Michael Okpara University of Agriculture, Umudike, for laboratory analysis to determine the toxic level.

Noting that the suspect had been handed over to the police for further interrogation, he said: “We are now sure that there are some fifth columnists that generate wastes in their states and dump them in Abia State. We believe that had been the practice and that is why we have been having problems cleaning up Aba.”

He said two other trucks had earlier discharged 60 tonnes of wastes on Coca-Cola Bus Stop also in Aba and escaped, stressing that ASEPA became worried when it discovered that its daily projection on the number of trucks needed to evacuate wastes on Port Harcourt Road in Aba was no longer enough.

Ikpeazu attributed this to the sudden emergence of what he called alien wastes, stressing: “To our greatest surprise on Monday morning ,we discovered that 37 trucks would be needed to evacuate the wastes on Port Harcourt Road, hence we started thinking that there must be something fishy.”

Boko-Haram Commander Killed In Sokoto

A top commander of the Boko Haram sect popularly called Buwayayye (meaning the untouchable in Hausa language) was killed while another was captured yesterday in Sokoto, after an eight-hour fierce gun battle between the sect and a combined team of security forces comprising soldiers and operatives of the State Security Service. Eleven people including women and children were rescued.

The brigade commander, 1 Brigade, Brig. Gen. Ta’siu Ibrahim, confirmed the operation that sent fear into the minds of residents within the vicinity. According to one of the locals, the residents were forced to say their last prayers, as all they could hear throughout the night was continuous gunshot.

The incident occurred around Gidan Dare, Kalambaina in Wamakko local government area of the state, where, the brigade commander claimed, the terrorists were successfully repelled.

The operation, which lasted almost eight hours, according to a military source, started at about 2am on Thursday (yesterday) and lasted until after 9am.

According to the source, the terrorists were engaged in fierce gun battle but were overcome, and the forces recorded no casualty. The source also added that the security forces killed and captured the terrorists, including their wives and children.

Briefing newsmen at the Azazi Hall of 1 Brigade, Sokoto Army Barracks, yesterday, the brigade commander enjoined every Nigerian to make peace a priority, just as he assured of the readiness of the security agents to ensure the safety of the lives and properties of all Nigerians, as well as protect her territorial integrity in line with global best practices at all times.

I want to intimate you with our activities within the last 24 hours in ensuring that the atmosphere of peace prevails, especially in this holy month that we are in -- the Ramadan period. Despite the fact that it is a holy month, a few hoodlums – to be specific, terrorists – are hell-bent on causing mayhem and destruction, and spilling the blood of innocent citizens, he said.

Speaking on the operational method, the commander said, On a tip-off, we undertook a joint operation in the general area of Gidan Dare, around the Kalambaina road, where a terrorist hideout was discovered.

Operations began in the earlier morning hours of today (yesterday) and I am pleased to inform you that the operation was hugely successful. During the course of the operation, fatalities on the part of the terrorists were recorded. To be precise, one of the terrorists was killed, one captured, five women and six children were rescued and they are very safe. Two of the women are pregnant and are receiving ante-natal care at the moment.

investigations revealed that the five women were from Borno, Zamfara, Kano, Sokoto states and the neighbouring Niger Republic. Of the six children rescued, one boy was aged 5, and another girl, 3. Two others boys were aged 2, and there was a 4-month-old infant girl.

The slain suspected suspect, believed to be a wanted person, was said to be a famous member of the terrorist group, while the captured accomplice, a male of about 20 years, was alive.

Gen. Ibrahim also thanked the people for their support: Without the cooperation of the good people of Sokoto State, most of the successes we are recording would have been impossible.

Gen. Ibrahim mentioned the items recovered within the household: six AK 47 rifles, a pump-action rifle, 13 magazines of ammunition, seven improvised explosive devices, 32 hi-watt (6f22) 9v batteries for transistor radios.

Other items include an axe, four handsets, 66 SIM cards, three memory cards, 10 Orlando Milk cartons, 56 detonator cables used in IEDs, three handset chargers, N76,685.00, 701 7.62mm ammunition rounds, 13 IEDs prime clocks, an Abuja vehicle plate number (EL 295 ABJ) and a wrist-watch, a copy of the complete Holy Qur’an, a prayer rosary (Tetsebi) and other Arabic books.

About four months ago, some suspected terrorists engaged the JTF in a similar gun battle and four of them were allegedly killed at Baddo Quarters in Wamakko local government area of Sokoto State.

Al-Mustapha Visits TB Joshua Immediately After Release

Al-Mustapha was released yesterday Friday July 12th after many years in prison, and his first port of call after his release was T.B Joshua's place.

T.B Joshua explains why Al-Mustapha visited him first:

I got to know him many years ago when a petition was addressed to General Bamaiyi who was the then Chairman of the NDLEA. As you know, several efforts had been made by my detractors to bring me and my ministry down. One of those efforts was that petition. I was arrested for investigation and it was later discovered that it was a tissue of lies. I spent nine days with them for investigation and they found the whole thing to be a fabrication. From there, I was taken to Aso Rock (City of Power) to see the president. It was there that I met Mustapha.


I was able to reveal to them who I am by telling them what was to come as a prophet. One of those things I mentioned to them and to Mustapha in particular, was what he went through, though he did not believe me then. That was why when it came to pass, I was the first person he remembered. I told him that he would spend several years in prison and would be finally released which no one else had ever told him.

That is why you see him coming here as his first port of call. Where there is no vision, people perish.

I am surprised you are asking me why he is coming here first. When you look into your archives as journalists, you will find many stories in the past about my visit to Aso Rock, (City of Power) while Bamaiyi was Chairman of NDLEA. Many magazines and newspapers published my visions and prophecies on the government and the presidency.

When you know your picture of tomorrow, it will impart a strength to endure your present difficulty. When you know what you are passing through now will not last long, you will endure it. Hon Michael Chinda, the lawmaker representing Obio/Akpor constituency II in the Rivers State House of Assembly, who was brutally attacked by Hon Chidi Lloyds has drifted to Coma after he underwent a reconstructive surgery over his damaged Jaw.

Hon Michael Chinda lost some of his teeth, knocked off with the House of Assembly Mace, he has deep cuts on the head, broken skull and lips.
Medical sources said that he is in a critical, but stable condition, but goes in and out of coma and his family are making efforts to take him overseas for further medical treatment

3-Storey Building Collapses In Kaduna, over 50 trapped.


Update coming out of kaduna says Rescue operations are still underway and it is belived that six children were trapped under the rubble. A six months old baby has been rescued but it is taught over 50 people are still trapped. Crowds gathered demanding the people trapped shouting for help should be saved but it took nema two hours to mobilize rescue geer, including renting a crane from julius berger. It is not known if their are dead. But one child was rescued, the fate of the others are unknown, NEMA says they are doing everything possible to rescue people trapped. And insisited that no one has died, but residents claimed a woman's dead body was pulled out of the rubble. The state governor is at the scene.

NOTE: nema has apologised for earlier reports that the building was built a 101 years ago. Rather, it is belived, it was built in the 80's by an alhaji and out of mud, which might be a major contributing factor.

Soyinka To Patience Jonathan - Be A Lady Before Being A "First Lady"

The wife of President Goodluck Jonathan, Patience, has been accused of getting away with murder in the country and of being used as a political tool, with the tacit support of her husband.

Making this allegation Thursday during an international press conference on the state of the nation, Nigeria’s Nobel laureate, Professor Wole Soyinka, who alongside human rights lawyer, Mr. Femi Falana (SAN), pointedly identified the first lady as being neck deep in the political crisis in Rivers State, added that her “seizure of Port Harcourt for 11 days with full security apparatus in tow, indicated that there is something about that madam herself.”

Falana and Soyinka condemned the crisis that had engulfed the Rivers State House of Assembly, when five out the 32 lawmakers attempted to impeach the speaker, Hon. Otelemaba Amachree.

Soyinka described the entire scenario as reflective of meddlesomeness and decried Mrs. Jonathan’s involvement in the crisis in the state, pointing out that she has no constitutional role in the country.

“This is getting to a state where an unelected person, a mere domestic appendage, can seize control of a place for 11 days and as a result of her presence, the governor of that state was told by policemen that you cannot pass here because the queen was there. What sort of jungle are we living in?

“A person with no constitutional position is able to enjoy the full security apparatus of the state which is being denied a governor,” he said.

He said his advice for the first lady was to be a lady before being a “first lady”.

“My worry for her is that she should be a lady first before being a first lady. You cannot be a first lady without first being a lady. That is the only advice I have for her,” he said.

8-month old baby stabbed 90 times with scissors by his mother

Eight months old Xiao Bao was stabbed 90 times in the face with scissors by his mother for biting her while she was breastfeeding him. The incident that has left many people shocked happened in Xuzhou, in the eastern China Jiangsu province. After the attack, the mother disappeared leaving the infant in a pool of his blood in the yard of their home. Xiao was found by his uncle who rushed him to the hospital. The baby needed more than 100 stitches. The mother, who has since been arrested, is not known to be suffering any kind of mental illness.

There are currently no national restrictions on the advertising and promotion of tobacco use in Nigeria. A campaign has recently been launched to raise awareness on the various health risks of smoking and second hand smoke, as well as the toll of tobacco use on the Nigerian population. Tobacco Control Nigeria is a behavioural change and public health campaign project using Social Media to advance tobacco control and support the passage of a comprehensive Tobacco Control (TC) law compliant with the World Health Organization’s Framework Convention on Tobacco Control (FCTC). According to the project campaign manager, Olamide Egbayelo “we  hope to nurture and give voice to a community of persons focused on ensuring that tobacco companies carry out their advertising and marketing responsibly. We want to ensure that Nigerian children are properly protected from pressures to take up smoking, that public places are protected from the tyranny of secondhand smoke, that persons who wish to quit smoking find the support they require.” The project will be launched in August.
However, in 2012, Nigeria conducted the Global Adults Tobacco Survey (GATS) and is the first country in the African region to do so. GATS aims to assist countries address selected demand-related articles of the World Health Organization on Tobacco Control (WHO FCTC). It also further supports the WHO MPOWER policy package
The report reveals that exposure to secondhand smoke is highest among those who visited restaurants. 29.3% of adults (6.4 million adults) were exposed to tobacco smoke when visiting restaurants. Nigeria has the opportunity to focus on prevention, stop initiation, and further decrease prevalence rates. Man electrocuted in Benin

BY GABRIEL    ENOGHOLASE BENIN – A middle-aged man identified as Friday Ekuase was, Monday, electrocuted in Benin following an early morning downpour.
Vanguard gathered that a Power Holding Company of Nigeria, PHCN, high tension wire was said to have fallen within the water-logged premises of the victim at  59, Gapiona Avenue, Benin City, resulting in the discharge ofelectric current in the flood water.
Ekuase was said to have stepped into the water and  electrocuted.
Reacting to the incident, Public Affairs Manager of the Benin Zone of PHCN, Mr. Babatunde Fadipe said: ”Whatever manner in which the accident occurred, the information on ground which we are investigating is that thehigh tension wire fell in the area where he traversed and unfortunately, he was electrocuted. The company is investigating with a view to preventing future occurrence.”

Nigerian student jailed for fake marriage in UK

A Nigerian  student in the UK, Jayeola Abiola, has been jailed for arranging  fake marriage between him and a Portuguese, Vania Pinheiro-Fernandes.
Abiola and his fake wife were jailed 12 and eight months each.
The duo met in a dance rehearsal and Abiola could barely pronounce her name, but he gave her $245 (N39,561) to get the things she needed for the wedding, while another Nigerian, Ayodeji Abbis, was paid £1,000 (N244,787) to act as the best man.
The wedding plans, however, went bad when the registrar at Hull Registry alerted the UK Border Agency that the couple about to get married barely know themselves when they were interviewed.
The border agency then secretly filmed the wedding videos of the cars, groom, bride and best man as they were leaving the hall before arresting them.
Gurdial Singh of the Hull Crown Court: said: “It is often said that sham marriages are too prevalent and strike at the heart of the country’s immigration system.”
Abiola, a 29 year old law student at Hull University and Pinheiro-Fernandes, also 29, appeared for sentence after pleading guilty to conspiracy to breachimmigration law by arranging a marriage so Abiola could remain in the UK.
Crown barrister David Bradshaw said Abiola’s visa was due to expire in January 2013,  few weeks after the marriage, scheduled for last November and knowing this he made a payment to one Abiola Kumoye to arrange a sham marriage.
“The marriage was fake because he was not in love with her. He didn’t want to set up a loving family unit. He did it because he wanted to stay in the UK,” the prosecution said.
The bride and organiser stood to gain because they were being paid for their services, he noted.
The total cost of the wedding was £5,000 (N1,223,935) and about £2,500 (N611,968) had been paid in advance while the rest was to be paid on completion.
Bradshaw said that the registrar became suspicious of the marriage when the bride gave a fake name and didn’t look like her picture in the passport and they were not convincing in answering questions.
Abiola Kumoye, 34, pleaded guilty to conspiracy to breach immigration lawand acquiring criminal property (£2,650: the first part of the fee for the sham marriage).
The judge adjourned the sentence on the best man Ayodeji Abbis, 25, who was also found guilty of conspiracy.
Andy Norris of the UK Border Agency said that sham marriages have grown considerably in the country and that they are working to tackle this head on.
“We will find and arrest anyone carrying out these crimes no matter where they are in the country,” he said.

Student, 29, jailed for attempted rape of 6yr-old girl

Abuja -  An Abuja Senior Magistrates’ Court on Thursday sentenced one student, Akande Abiodun, 29, of Kuchingoro, Airport Road, to three months imprisonment for attempted defilement.
Senior Magistrate Nafisat Ibrahim sentenced the accused with an option of N10,000 fine after he pleaded guilty to the charge.
Earlier, the Police prosecutor, Cpl. Francis Tanko, told the court that one Emmaunella Osajie, the mother of six-year-old girl of 86 Army Barracks, Kubwa, reported the case at the Wuse Police station.
Tanko said that the complainant had reported that the convict came to her office at Poly Plaza, Wuse, on the pretext of coming to type a document.
He said that the convict made advances at her child, took her upstairs, kissed her twice on the lips and put his finger in her private part thereby trying to defile the child.
According to him, the child ran and alerted her mother of the incident.
The accused, while pleading guilty told the court, “My Lord, it was a devil’s handwork, and I will not do that again.’’ (NAN)

How Man, 27, Met His Death On A Peace Mission

An attempt by a 27 years old apprentice, Elijah Chiama to make peace, in a case involving two of his relations ended in tragedy when he met his untimely death in the hands of a killer gang.
The incident occurred in Ukpata community in Uzo-Uwani Local GovernmentArea of Enugu State, on May 15 when Chiama accompanied his cousin Ebuka Eze to a neigbouring village, Umunakwe Village  in the same community to resolve a misunderstanding which was already taking a violent dimension.
According to a source which spoke with LEADERSHIP, trouble started when his cousin, Ebuka, had a little misunderstanding with one Miss Chinasa Okeke, also one of his extended family members. The source disclosed that another man, one Okeke Okoro  who was contacted by Chinasa’s cousin, Ndidiamaka Iheatisi, to deal with Ebuka, said to be having love affairs with Chinasa, went to Ebuka and ordered him to go and apologise to Chinasa, failing which, he should be ready for any trouble.
Ebuka was said to have declined insisting that the right thing would be for Okoro to invite both of   them and resolve the problem instead of ordering him to apologise. According to him, he did not commit any offence and so would not apologise to anybody. Irked by Ebuka’s response, Okoro and four other young men from Umunnakwe Village, were said to have laid an ambush for Ebuka when he went to recharge his mobile phone and gave him the beating of his life. His assailants were said to have made away with his face-cap and sandals after the assault.
It was further learnt that the following day Elijah accompanied Ebuka to the home of his attackers to strike a peace deal and also recovers Ebuka’s items that were seized from him during the attack. LEADERSHIP learnt that they were still halfway on the journey when Okoro, accompanied by others, including Chikwado Okoro, Amaechi Okoro, Udoka Ugwu and Emeka Ogbonna confronted them armed to the teeth.
The eye-witness told LEADERSHIP that the attackers who came with knifes, axe, sticks and a pump action gun allegedly given them by the father of two of the suspected killers, Chikwado and Amaechi Okoro, beat the duo so much that Elijah was killed on the spot while Ebuka managed to escape with a deep gash on the head from the axe. It was however not confirmed that there was any gunshot wound.
Speaking with one of the deceased’s family members, Mr Livinus Chiama who said that the police should ensure that no stone is left unturned to ensure that the killers of Elijah pay the price for their crime lamented that what made the case more painful is that Elijah actually went to make peace between his cousin and the attackers.
“Ndidiamaka Ihaeatisi, a cousin to Chinasa forced herself into the matter and became too malicious to the extent of conspiring with members of the killer-gang to beat Ebuka. They then started planning how to attack and beat Ebuka. The first person to attempt executing their plans was Okeke Okoro, one of the suspects. Okeke Okoro confronted Ebuka and demanded that he should go and tender an unreserved apology to Chinasa for beating her.
“Ebuka objected, arguing that he could explain his own version if Chinasa was summoned and not him to go and apologize as if he was guilty. This objection of Ebuka did not go down well with Okeke because he later traced Ebuka to his grandmother’s house, threatening to make him face the wrath of his action,” Chiama said.
Lamenting the gruesome murder, Chiama, pointed out that their son was killed in a very regrettable way because he died while making peace. According to him, the killers of their son have committed the most grievous crime on earth. “We therefore, expect justice to take its course as we cannot take up arms to avenge his murder. The suspects should not go free so as to serve as deterrent to others. For us, the pain is an endless one’, he said.
An eye witness, Mr Godfrey Igweze, revealed that Okeke’s words of threat were, ‘it is either I kill Ebuka or Ebuka should kill me”. He said it took the intervention of several persons who saw the rage in him to save the situation and convince him to go back home.
“Expectedly, everybody thought the matter was over; nobody knew that Okeke and his gang of killers had another agenda, including a plan to maim and kill. So, on a later day when Ebuka was coming back from a business center where he went to charge his mobile phone, he was waylaid by the suspects who beat him up and seized his footwear and cap.”
“The following day after Ebuka was attacked, his cousin, Elijah went with him to dialogue with his attackers, with the hope of making peace between the two parties and to recover Ebuka’s seized items. That was following the advice by elders from Umuezeanokwuru village where Ebuka and Elijah come from. According to Ebuka, they didn’t go there to fight with anybody.
“Unfortunately, Elijah did not come back alive from that peace mission. On sighting the duo of Ebuka and Elijah at a public square, the attackers, numbering five unleashed a mass attack on them with deadly weapons including axes, iron pipes, sticks, machetes and even a gun. Elijah was killed at the spot while Ebuka narrowly escaped with skull-deep axe injury. It took the intervention of sympathisers to lift Elijah from the pool of his own blood. All efforts to revive him failed as he never said any word or shook his body from that moment. Blood was gushing out from his nose, mouth and ears,” Igweze said.
Mother of the deceased, Mrs Caroline Chiama, while speaking with LEADERSHIP, said her son’s, killers have taken away her joy. She prayed the Enugu State government to ensure that those who killed her son did not escape the wrath of the law.
Following the incident, the deceased’s family members reported the case to Adani Police Division, Uzo-Uwani Local Government Area where the corpsewas taken to before it was deposited in a mortuary.
LEADERSHIP learnt that through the concerted efforts of the deceased’s family members, Umuezeanokwuru Youths and members of Security Vigilante group in Affa, Udi LGA of Enugu State who were alerted over the incident,  four of the suspects were arrested on 26th May in a neigbouring community, Affa, in Udi Local Government Area where they escaped to.
They were subsequently handed over to officers of Criminal Investigation Department (CID), D4, Enugu, where the case was transferred to for further investigation. LEADERSHIP learnt that the arrested suspects include, Chikwado Okoro, Amaechi Okoro, Udoka Ugwu and Okeke Okoro.
When contacted on the issue the Enugu State Police Command Public Relations Officer, Ebere Amarizu confirmed the incident saying that the command was still investigating it. He assured that no stone would be left unturned to bring all the culprits to book. “the case is under investigation and as soon as it is concluded we shall brief you appropriately, including the number of arrest made,” he said.

Dad Begs For Forgiveness For Defiling His Daughters.

LAGOS - Policemen attached to Ikotun division in Lagos have arrested a man alleged to have been having carnal knowledge of his two daughters between the ages of 10 and 13, in the past two years.

His daughters reportedly claimed to have been going through what they described as horrible experience since their mother left them for another man.

Unable to resist their father, they endured until the elder girl confided in her friend's mother, who then contacted some child rights groups.

The organisations were said to have effected the man's arrest at his 29, Omooye Street, Abaranje, last Saturday and handed him over to policemen at Ikotun division.

Explaining, the elder child (names withheld) said: "Our father started it when I was 11 years old. I did not know he was doing same to my sister who was then eight years.

I only got to know when I saw her blood stained undies and when I demanded to know whether she had started seeing her monthly flow, she revealed that our father slept with her the previous night. He usually crept to either of us at night whenever he wanted to satisfy his urge. He was the one who dis-virgined us."

I beg to be forgiven -Suspect

On his part, the 35-year-old suspect , a commercial bus driver identified as Adewale Adeleke, admitted to the police that he committed the sacrilegious act. He claimed, however, that he did not know what usually comes over him at that point.

Hear him: "I beg to be forgiven. This is the handiwork of the devil because I do not know what usually comes over me. What usually happened was that the urge would just come and before I know it, I would be with either of them."

When news of the act reached the mother of the children who resides in Ibadan, the Oyo State capital, she reportedly rushed to Lagos, where she was quoted as saying that she was shocked beyond words.

She reportedly said she was forced to leave her husband because of alleged battering, in spite of the fact that she was the one responsible for the upkeep of the home. She said while leaving, she handed her two children to her mother with the intention of sending them monthly allowance, only for their father to go and take them.

Executive Director of Esther Child Rights Foundation, Mrs. Esther Ogwu, said her foundation was making effort to ensure that the woman would take custody of her children, adding also that the arrest of the suspect was a first step to ensure that justice was done.

The two girls are now under police protection while their father will be arraigned at the Ejigbo Magistrate's Court by the police.

When contacted, Lagos State Police Command, Public Relations Officer, PPRO, Ngozi Braide confirmed the arrest of the suspect, saying that he would be arraigned in court soon.

Zambian Man Bites Python That Tried To Kill Him

When going about your job, the last thing you’d expect is for a giant python to drop on your head. Yet it did happen to Kelvin Katoka from Zambia, who was driving an excavator near a copper mine in the North Western part of the country.

A rock python, Africa’s largest snake, dropped onto him and started to strangle the 25-year old. Katoka fought back, biting and kicking at the reptile.

He then pulled out a small knife and stabbed the snake several times, all while realising he was losing consciousness, writes The Telegraph (UK).

The snake kept at it and Katoka said he could feel the saliva on his head as the python started to swallow him. Rock pythons are known to eat prey as large as wildebeest and crocodiles. Fortunately the fighting bought Katoka valuable time - two co-workers found him and killed the snake.

Katoka was rushed to hospital, where he is still recovering.

Graduates With Fake NYSC Call-up Letters Sentenced

A Chief Magistrates’ Court in Dutse, on Wednesday sentenced three university graduates to three months imprisonment each for possessing fake National Youth Service Corps (NYSC) call-up letters.

Chief Magistrate Kabir Lamido sentenced Ale Oluwaseun, 25; Owolabi Saheed and Makinde Lanre, both aged 23, who pleaded guilty to the one count charge, during arraignment.

Lamido, however, gave each of them an option of N5, 000 fine and warned them to desist from illegal acts.

The prosecutor, Cpl. Garba Abdul, had earlier told the court that the three men came to an NYSC Orientation Camp with the fake letters and pretended to be intending corps members, adding that an employee of the NYSC, Ejibunu Zachary, reported the case to the Kubwa police area command on June 26.

He submitted that the offence contravened Section 366 of the Penal Code.

The graduates had pleaded for leniency, saying they were Nigerian graduates of the University of Cotonou, Benin Republic, desirous of serving their fatherland.

They said a man who claimed to be an official of the NYSC, issued the letters to them when they were making enquiries about the scheme.

you recall, last month, the dismembered remains of a student of Lautech was found behind a guesthouse. Her friends claimed she left the hostel to meet her boyfriend and didn't return .

The Oyo State Police Command on Wednesday paraded Alex Akinyemi, an alleged accomplice in the killing of a student of Ladoke Akintola University of Technology, Ogbomosho, Miss Seun Adaramoye.

The remains of Adaramoye were found by passersby near a guest house at Under-G area of Ogbomosho on June 20, 2013.




Assistant Commissioner of Police, State Criminal Investigation Department, Iyanganku, Ibadan, Dansuki Galadanchi, said upon investigation, the owner of the guest house where the corpse was found told the police that his security guard was involved in the murder.

Galadanchi said, “When the owner of that guest house heard about the incident, he called the CCTV engineer to play back the video camera recording.

“He saw where one of his security men, Alex Akinyemi, carried the corpse. He quickly reported the matter to the police.

“On the receipt of the case, police swung into action and the security guards, namely Dauda Aliyu and Samuel Ojo, were arrested.

“When the CCTV was played back, they (guards) identified the person in the film to be one Alex Akinyemi, a day guard at the guest house at Under-G area of Ogbomosho.”

He explained that the security guard was arrested on July 6 in Ogbomosho.

He added that the corpse of the student was removed and taken to LAUTECH teaching hospital for post mortem.

Galadanchi said efforts were being intensified to arrest the fleeing suspect, Charles Aregbesola, while further investigation was being conducted.

The suspect, however, insisted that he was not the killer, saying another man he identified simply as Segun, was responsible.

Akinyemi said, “I have been working as a security guard in this guest house for over two months.

“I only know Segun aka police, as a resident of that area before I saw him dropping the corpse around 8am that day.
“He threatened to kill me with an axe that he was holding that day if I reported him to the police. He promised to give me N500, 000 but he did not give me.”

Army Smashes Police Robbery Gang In Bayelsa

The 4th Brigade of the Nigeria Army has smashed a police robbery gang allegedly led by an Assistant Superintendent of Police, Okubopagha.

It said ASP Okubopagha and Inspector Okoro were from the B Department, Nigeria Police Force, Bayelsa State Command.

The Commander of the 4th Brigade, Pat Akem, who spoke through the unit Public Relation Officer, Capt. Roseline Managbe, said the smashing of the gang followed the arrest of one Nanagha Aduoumemi who claimed to be an Inspector in the A Department of the Bayelsa State Command.

Capt. Managbe said Inspector Okubopagha was arrested by troops of the 222 Battalion at Orhoror junction along Bomadi road in Delta State after blocking the road with woods while other members of the gang hid in the bush.

She said the Inspector was arrested while attempting to run into the bush while other members of the gang escaped into the creeks.

“The suspect revealed that members of his gang are all serving police personnel who indulge in robbery activities after their normal police duties, “the spokesperson said.

Building Collapsed At Ebute Meta, Killing 6

The death toll in a collapsed building, early Thursday, in Lagos has risen to six.

Emergency rescue officials told PREMIUM TIMES that seven people, including two children aged 2 and 4, have been rescued from the rubble.

The 3-storey building at Oloto Street, Ebute Meta, collapsed at about 2.35 a.m. trapping about 10 people.
Rescue efforts are still ongoing.
