Osogbo — An Osogbo Senior Magistrate Court, Osun State has remanded a 55-year-old man,Titiloye Tella, for allegedly defiling and raping an 11-year-olg girl simply identified as ‘Tapepa’ (not real name) in his (Tella) bedroom.
According to the charge, Tella, a farmer, allegedly perpetrated the act on August 31, 2013 at 9 am in Temidire area of Gbongan, Ayedaade Local Government Area of the state.
The charge read: “That you Titiloye Tella did unlawfully have carnal knowledge of one ‘Tapepa’, aged 11 years, by dragging her into the yard of your house and cover her mouth with clothe and thereby committed an offence contrary to and punishable under section 218 of the Criminal Code Cap 34, Vol. II, Laws of Osun State of Nigeria, 2003.”
The police prosecutor, Wilson Mireti, further informed the court that the accused at the same time and in aforementioned area did unlawfully and indecently assault the helpless young girl by having carnal knowledge of Tapepa without her consent, arguing that Tella has committed an offence contrary and punishable under section 222 of the Criminal Code of Nigeria.
It was gathered that the victim who hawks old newspapers was called by Tella to buy her ware. After Tella had bought N20 newspaper from Tapepa, he allegedly gagged and dragged her into his bedroom where he allegedly raped her.
The girl was said to have narrated her ordeal to his father who immediately reported the matter at the Family Unit of the Oja Oba Police Station in Osogbo.
But, the accused, who said that he had been living alone since his wife divorced him, pleaded not guilty to the two-count charge preffered against him.
The presiding Senior Magistrate, Mr Olusola Aluko, ruled that Tella be remanded in Ilesa Prison custody while his lawyer, Mr. S. B. Ajibade is to furnish the court with a written application for bail.
The magistrate then adjourned the case till December 11, 2013.
